๐Ÿ“Š Methodology (v4.0 - Active Postings Risk Assessment)

Risk Assessment Score (0-100+): Natural scoring model for active LMIA job postings. Higher scores indicate statistical patterns suggesting potential compliance concerns based on wage, skill level, and affordability metrics. Scores naturally sum to 0-100 with optional +5 IRCC violator bonus and +15 no posting penalty.

Risk indicators considered (6 core factors):

  • ๐Ÿ†• Wage Premium Analysis (0-40 pts): If employers "can't find anyone," wages should exceed baseline, not meet minimum. At/below median = 40 pts, 1-5% above = 30 pts, 6-10% above = 20 pts, 11-20% above = 10 pts, >20% above = 0 pts
  • Low-Skill Position Penalty (TEER) (0-15 pts): Based on NOC TEER level. TEER 5 = 15 pts, TEER 4 = 10 pts, TEER 3 = 5 pts. Low-skill positions are easiest to train locals for
  • High-Risk Occupation (0-15 pts): Occupations with historically higher exploitation rates (food service, accommodation, cleaning, labour)
  • Affordability Crisis (0-15 pts): Wage must be sufficient to live in work location. Below living wage = 15 pts, monthly income < 1.5x rent = 10 pts, < 2x rent = 5 pts
  • Industry Risk Profile (0-10 pts): Certain industries have documented patterns of TFW program abuse: food service, accommodation, cleaning services, general labour
  • No Public Posting Penalty (0-15 pts): LMIA requires public job posting attempts. If no active Job Bank posting found when checking, may indicate employer didn't genuinely try to hire Canadians
  • Known IRCC Violator (0-5 pts bonus): Employer appears on IRCC Non-Compliant Employers list. Requires exact employer name + province match for legal defensibility
