๐Ÿ“Š Methodology (v3.1 - Job Bank Verification Integration)

Risk Assessment Score (0-100): Higher scores indicate statistical patterns that may indicate potential compliance concerns, based on publicly available government data. Version 3.1 adds Job Bank posting verification to assess employer compliance with LMIA advertising requirements.

๐Ÿ” Job Bank Posting Verification

Data Collection: One-time research study conducted November 26, 2025. Searched Job Bank for 15,281 LMIA employers to verify compliance with public posting requirements.

Key Finding: 99.94% of LMIA employers (15,272 of 15,281) had no public job posting found on Job Bank at time of check.

Limitations: Data reflects Job Bank postings available on November 26, 2025 only. Employers may have posted on other platforms or at different times. Absence of posting does not prove non-compliance.

Risk indicators considered (9 factors):

  • Wage Premium Analysis (0-40 pts): If employers "can't find anyone," wages should exceed baseline, not meet minimum. At/below median = 40 pts, 1-5% above = 30 pts, 6-10% above = 20 pts, 11-20% above = 10 pts, >20% above = 0 pts
  • Low-Skill Position Penalty (0-15 pts): Based on NOC TEER level. TEER 5 = 15 pts, TEER 4 = 10 pts, TEER 3 = 5 pts. Low-skill positions are easiest to train locals for; high LMIA usage suggests insufficient local recruitment
  • High-Risk Occupation (0-15 pts): Occupations with historically higher exploitation rates (food service, accommodation, cleaning, labour)
  • Large-Scale Hiring (0-15 pts): Bulk position requests per application (20+ positions = 15 pts, 10-19 = 10 pts, 5-9 = 5 pts)
  • Corporate Transparency (0-10 pts): Unknown incorporation status may indicate informal operations
  • Affordability Crisis (0-15 pts): Wage must be sufficient to live in work location. Below living wage = 15 pts, monthly income < 1.5x rent = 10 pts, < 2x rent = 5 pts
  • Industry Risk Profile (0-10 pts): Certain industries have documented patterns of TFW program abuse: food service, accommodation, cleaning services, general labour
  • Repeat Applicant Pattern (0-10 pts): Chronic LMIA use suggests retention issues or systemic reliance on temporary workers (10+ LMIAs = 10 pts, 5-9 = 5 pts)
  • ๐Ÿ†• No Public Posting (0-15 pts): LMIA rules require public advertising on Job Bank. No posting found (as of Nov 26, 2025) = 15 pts. Note: Check date is historical; recent postings may exist.
